Negligent Hiring

There was a story I heard about an employee suing his former employer for negligent hiring; his claim was that the employee knew about his condition, but deliberately let him go for no reason. The employer could have avoided this situation easily by making sure a proper hiring exercise was carried out, or better still contracted it out, to a reputable outsourcing firm. Incidences such as above could occur in any form, so to avoid it, careful attention must be paid when hiring new staff or even considering retaining temporary staff.

A legal claim made against an employer by a damaged employee who claims that the employer either knew about or should have known about a situation in the employee’s past that indicates they may be violent or untrustworthy. A business can help avoid negligent hiring claims by performing a background check, that also includes drug test and medical exam prior to hiring a new employee.

According to business dictionary, negligent hiring is a legal claim made against an employer by a damaged employee who claims that the employer either knew about or should have known about a situation in the employee’s past that indicates they may be violent or untrustworthy.

There are several cases of negligent hiring. Some of them are; “hiring an employee with a past criminal record of rape, bullying, theft etc.” Negligent hiring occurs every day as so many companies fail to run background check on their staff before hiring them.

Proof that a particular individual is skilled in a certain activity isn’t just enough reason to hire him/her. You have to be willing to dig deeper, you have to be willing to find out a lot more about that new staff you are about to hire. Hiring the wrong employee without a proper background check, can lead to huge financial loss or even worse, brand damage.

With background check, situations surrounding negligent hiring can be completely avoided. Every employer should ensure that he/she partners with a trustworthy background check company. Background check doesn’t just stop at pre-employment. Employers should endeavor to carry out background check on their staff periodically.
